Oklahoma law gives 1/3 of the estate to the surviving spouse and the remaining 2/3 divided equally among the surviving children. Circuit Court Judge F. B. Swank ruled in T.E.'s favor and awarded him 1/3 of the estate and validated the sale of the contested property.
