Note: On June 1, 1914, Iva Elwood Chastain sued T.E.Sterling, etal. Mary E. Sterling died intestate on 10/9/1909. Iva maintained that the Indian land that her mother owned, should have been divided among the descendants of Tandy Stephens, her father, and a member of the Chocktaw Nation. This would comply with Chocktaw law. She also maintained that her step-father, T.E.Sterling, cheated Elisha, Nellie and Magnita and her of property. Oklahoma law gives 1/3 of the estate to the surviving spouse and the remaining 2/3 divided equally among the surviving children. Circuit Court Judge F. B. Swank ruled in T.E.'s favor and awarded him 1/3 of the estate and validated the sale of the contested property.
